Terms of Business
What we should expect from each other:
1.0. Description
The terms ’Catz-i.com’ & Catz-i.com ADIT and ’we’ relates directly to 'the business’.
’Catz-eye.com’ is the parent business.
The terms ‘we’, ‘Approved Driving Instructor, ‘ADI’, ‘instructor’ and ‘trainer’ all refers to the person giving paid instruction and ’NOT’ Catz-i.com.
The terms ‘student’, ‘pupil’, ‘you’ and ‘driver’ refers to the person taking and/or paying for tuition respectively.
2.0. Vehicle
The vehicle will be presented to you in a clean, road worthy and legal condition. Should there be any mechanical failure including dashboard warning lights, punctures or bulbs we do reserve the right not to allow the vehicle to be used until the fault is rectified. We will attempt to rectify any problem for you within a reasonable time frame. In situations beyond our control we cannot be held liable should we be in a position where your lesson or test cannot be carried out or continue and a future lesson will be arranged for you. Should the fault present itself during your lesson, the time you were unable to drive will be credited to your next lesson. With reference to clause 10.0 below; If the fault coincides with the time you would use our vehicle on test, we will make every effort to arrange another vehicle for you. If this is not possible, we will not charge you for the hire of the vehicle for the purpose of the test, but we will exhaust all efforts on your behalf, however we are unable to compensate you should your test not go ahead.
2.1. You The Vehicle & The Law
We are required by law to refuse use of the vehicle if we suspect that the you could be under the influence of alcohol and/or drugs. As an example, should you drive over the prescribed limits, your Instructor is also culpable and by checking, you should not take offence to this. The result will be confidential and will not be shared with anyone else outside of Catz-i.com ADiT, unless legally obliged to do so.
We do not require legally binding proof to refuse to give the lesson, and you should refer to clause 5.1 below.
2.2. Personal Conduct
Should you be prone to a weak bladder or bowel, you are advised to deal with this in a suitable manner before each driving lesson. If you need the toilet during the lesson, please tell your Instructor and they will direct you to the most suitable facility. Please note that this may not necessarily be the closest. Should you feel that you are going to vomit (be sick), you must inform your Instructor immediately and they will pull in to a safe & legal position for you as soon as possible.
2.3. Personal Responsibility
Should you be responsible for soiling any part of the interior of the vehicle, including (but not limited to); the seat, carpet, fixtures and/or fittings, you will be charged for professional cleaning or replacement. The amount charged will include the value for lessons that need to be cancelled until the cleaning and/or repairs have been made. The amount charged shall be up to a maximum value of £1,000 in lost business and the cost of replacement fixtures shall not exceed the Recommended Retail Price (RRP). All receipts and/or statements will be produced to you as evidence if required. Please refer to Clause 8.1 below if this amount is disputed.
The above terms also apply to dirty clothing, shoes or hands, where cleaning and odour removal fees may apply and may also incur the cost of any lessons that have been cancelled as a direct result of any or all of these.
2.4. Insurance
Your Instructor’s will have adequate insurance to cover you and the vehicle. Dual Controls are also fitted for your (and our) peace of mind and safety. An Insurance excess fee of £100.00 is payable by you the driver in the event of damage caused to the vehicle during a lesson or training session if this was caused by you not following an instruction, or as a result of behaviour that your Instructor could not have predicted. This includes wheel and tyre damaged due to kerb strikes resulting in significant damage.
3.0. Personal Conduct
The Instructor and pupil will try to avoid physical contact at all times except in an emergency, or in the normal course of greeting. The Instructor will at all times behave in a professional manner towards you. Texts, calls, emails and social media contact will only be in connection with driving lessons.
3.1. Abuse
We have the right to work without physical or verbal abuse. All instances will be reported to the Police and we reserve the right not to give further instruction. This includes abuse towards driving test examiners, which undermines our credibility, and yours.
3.2. Personal Appearance
Your Instructor will always dress appropriately and will normally wear a Catz-i.com ADiT uniform and trousers. In the course of learning to drive, the Instructor must pay close attention to what is being used in the vehicle and in doing so will watch your eyes, hands and feet. To avoid embarrassment or miss-interpretation by either party, please avoid wearing short skirts or shorts.
3.3. Religious head wear
There are many religions that require a head scarf or garment. Whilst we respect all faiths, and religions beliefs, on the grounds of safety, we must be able to see the learners face. Therefore burka’s are not acceptable.
3.4. Allergies
We may provide alcohol hand gel at the beginning and end of the lesson. This is to prevent the spread of colds, flu and viruses, including coronavirus. Should you be allergic to alcohol, please inform your Instructor and non alcohol hand wipes can be made available to you.
3.5. Coronavirus
Should you have a bad cold, flu, or coronavirus, please respect that you will be in a confined space for some time. Therefore, you should NOT take your driving lesson, where you risk passing the virus to everyone else that uses the vehicle. Make sure that you follow government guidelines at the time on Coronavirus, and in these circumstances, we make exceptions for cancellations.
3.6. Odours
You should avoid wearing strong smelling perfumes or aftershave, which can be overpowering in a small environment. Adequate deodorant is expected to be worn at all times.
3.7. Language
Your Instructor will speak English at all times and you MUST be able to speak fluent English on grounds of safety. In the event of miscommunications that are safety critical, or impact on the
quality of your training, we reserve the right not to continue lessons, however, we will attempt everything possible to amend the situation for you to avoid this.
Whilst we respect that everyone express’ themselves differently, please try not to use foul language and you should expect the same from your Instructor.
3.8. Licence Check
Prior to your first lesson you should follow the link in the Catz-i.com ADiT Total Drive App, or by using the https://www.gov.uk/view-driving-licence. You will require your Driving Licence and National Insurance Number to complete the authorisation. You will then be given a code for us to check your Driving Licence for any restrictions. We cannot allow you to drive on public roads without this information.
If your name or address changes, you must inform DVLA, as this carries a £1,000 government fine. If you are a college or university student living away from home, we will advise you on the best course of action.
3.9. Entitlement Changes
Should at any point after your licence is checked by your Instructor, be awarded points on your licence, it is suspended or revoked (taken away by a Police Officer or the courts), you have a legal requirement to inform us of this. Failure to do so will result in a civil action being brought against you.
4.0. Mentoring & Disabilities
ALL disabilities, syndromes & any other illness MUST be reported to your Instructor on or before your first lesson. This includes those who are or think that they are pregnant. {Medical Information is covered under our GDPR Policy and will NOT be shared with anyone else}. If you believe that you are or could be pregnant, your Instructor will mark your Total Drive App, but will not use the word ‘pregnant’ to ensure total privacy}. This will allow us to work with you to ensure your learning needs are met and to ensure you and your Instructor is safe, legal and covered by the Instructors and/or vehicles insurance. Failure to disclose this information may lead to litigation and a civil action being brought against you.
4.1. Right to Refuse
The trainer at all times reserves the right not to give instruction, this will not contravene legislation on discrimination, including; sexuality, religion or disability. If this relates to a physical or mental disability, we will carry out assessments and make every effort to accommodate and where necessary through government & professional bodies. If we are unable to carry out further lessons due to restrictions of a temporary or permanent disability, we reserve the right to seek advise on further training and/or adaptions as necessary, which we will convey to you. In most cases the cost of adaptations is the Learners responsibility, however these adaptations will be yours and normally universal, meaning that you will also be able to use them in your future vehicle(s). The time fitting and removing these for your lesson or training Session may also be chargeable.
5.0. Medications & Alcohol
You MUST inform us if you take any medication, including cold remedies or antihistamines. In most instances there is no issue, however we do need to be aware for safety, insurance and legal purposes. Under the drink drive laws, we require you NOT to consume any alcohol within 24hours before your driving lesson. Your Instructor reserves the right to ask when you last drank alcohol and may ask you to use a mobile breathalyser to verify. If in any doubt, your Instructor reserves the right to refuse the driving lesson with you. With a Provisional Driving Licence, you can still be banned from driving and have a criminal record for a maximum of 20 years. Your Instructor may also be charged for aiding and abetting, where the Instructor reserves the right to claim loss of earnings from you to a maximum of £2,000,000.00
5.1 Illegal Drug Use
If a circumstance arises where you and/or your Instructor is unsure as to your legality, they reserve the right to refuse the lesson until a test is carried out. Your Instructor will provide an approved testing kit for you at the time and you will be asked to provide a sample of a swab your tongue. If this is negative you may carry on with the lesson as normal. Should the test prove positive, the lesson will be chargeable and any future tests will be chargeable at £4.95 each.
6.0. Property
Please do remember to take all your belongings with you at the end of each lesson. We cannot be held responsible for anything you leave behind or damage to items how-so-ever caused.
7.0. Training Routes
Depending on your experience the first 5–10 sessions need to take into account things like rush
hour, adverse weather conditions and possibly the necessity to drive you to a better location for your training. This avoids unnecessary nerves and stress for you where you can learn without the pressure of a queue of vehicles behind you. At times, we may need to postpone a lesson at short notice due to adverse weather conditions, mechanical or electrical failure or a flat tyre. There may be other factors out-with our control, such as roadworks, road closures, traffic congestion, act of terrorism, or act of God that impedes your Instructors journey. In these circumstances, these matters cannot always be predicted and should your lesson be cancelled, you will NOT BE CHARGED.
7.1. Pick up Location
We are happy to pick you up and/or drop you off from your home, school, college or university. However, this MUST be agreed with your Instructor before the day of your lesson, and may not always be possible based on your driving ability and area your Instructor is working in that day.
7.2. Running Late
With reference to clause 7.0, if your Instructor is running late by more than 10 minutes, they will call or text to let you know. The Catz-i.com ADiT Total Drive App, will inform you that they are on their way. If you don’t hear from them, you should contact them to ensure that you both have the correct times in your diaries.
Upon arrival your Instructor will check that you are okay to run late. If you are unable to do this, you will have two options;
1/. You have the time added to your next lesson.
2/. The price is reduced for the lesson that day. If the Instructor is regularly late, it will not be possible to continue lessons with you in the interest of fairness to you.
7.3. Rescheduling
In the event that the Instructor has a cancellation, they may contact you to see if you can change your time to ease their schedule. You are under no obligation to accept this and if you cannot do this time we will honour your arranged time.
8.0. Cancellation
This part should go without saying, but you MUST give “Your Instructor” 24 hours notice if you need to cancel your 60 minute (1hr) or 90 minute (1.5hr) lesson. For a 120 minute (2hrs) or more lesson, and/or on Sundays & Bank Holiday Mondays you MUST give ”Your Instructor” 48 hours notice. Under this time we may be unable to fill your slot and as your Instructor is self-employed, the lesson will be chargeable at the normal rate.
If your Instructor is unable to conduct your lesson or training for a period of time, we will provide you with another Instructor wherever possible and in the same type of vehicle if possible. If this is not possible we will do our best to find you another Instructor with a similar vehicle.
8.1. Payment Methods
Payment is due on, or before the time of your lesson, and can be made on the Catz-i.com ADiT Total Drive App*, using Apple Pay* or Google Pay*, with a Credit or Debit Card, using the PayPal* link on the website or by BACS transfer.
*These services may charge a small transaction fee, depending on the amount.
8.2. Unpaid Lesson Charge
If you do not pay at the time of your lesson or training session', an un-paid lesson incurs a Penalty Charge off £1.00 per day until paid in full. Should the account not be settled within 30 days, a letter is sent to you as a reminder with a further administration charge of £20.00. If the debt continues for a further 90 days, you will be liable for the lesson fee - £120.00 in late fees. At this stage, we will take the matter to the Small Claims Court. You will then be liable for any additional letters we send you, which will be changed at £20.00 each, all court and legal fees, plus travel and accommodation (where necessary). Your Credit Score may also be affected.
8.3. Payers Entitlement
Should a parent, guardian, spouse, person or company wish to know of the Learners progress, this can only occur with the Learners express permission, under the ICO GDPR Act 2018, even if the enquirer is paying for the lessons and the Learner is 18 years or over.
8.4. Prices
Please check our Web site at www.Catz-i.com for our latest prices and offers. All figures are correct at the time of publishing. Prices are subject to change and reviewed 01 April and 01 October of each year. Further price changes may happen at any time if fuel prices rise by £0.10 pence per litre or more.
8.5. Price Increase Notice
Two weeks notice will be given to you in writing of any price increase. If you have made an advanced payment, the price will not increase.
8.6. Discounted Payments
Block Bookings are ONLY VALID if paid in advance. Otherwise the full hourly rate is payable. Visit our website and click your Instructor to find their current prices.
8.6. Advanced Payment Validity
Block Bookings are non-refundable under normal circumstances and valid for six months if regular lessons are being taken.
9.0. Business Dealings
• Your Trainer will keep records of any money you pay in advance in the Catz-i.com ADiT
Total Drive App. You can login and view this at any time.
• All money paid in advance forms a contract with ‘Your Instructor’, NOT Catz-i.com
ADiT, even if this was paid on our website.
• Any complaints should be directed towards your Instructor in the first instance. If this does not resolve the matter, please make your dissatisfaction in writing to an address below;

We will attempt to resolve the matter with you. If this does not resolve the matter, we will include the DVSA if necessary. If this does not resolve the concern, then you may set up a panel with representatives from the ADI industry, who may refer the matter to the courts or statutory body to be determined.
10.0. Test Day
Using our Catz-i.com ADiT Total Drive App, you will be able to measure your Progress & Development, and you will know when to apply for your test. If we have advised against the test due to your ability and/or consistency with your training, or in the case of a potentially dangerous pre-test lesson or training session, we reserve the right not to allow you to do your test in one of our vehicles. In this instance, we cannot accept responsible or liability for the test attempt, nor test fees lost as a result.
10.1. Documents
Whilst the Instructor will remind the learner or student of which paperwork to bring to test, it is the test candidates responsibility to ensure that they are brought with them to test. If documents cannot be found on the day of test, and the test cannot be conducted, the pretest lesson and vehicle hire is still chargeable, however, this can be used as if it was a normal lesson at the time you would normally have gone for test.
10.2. Test day prices
The driving test fee is paid to DVSA and does not include the use of the vehicle for test. You should ONLY USE THE DVSA LINK provided in the Catz-i.com ADiT Total Drive App. There are many fraudulent sites, that charge extra fees, that are completely unnecessary, and in some cases, you may book a test, then find that no real test exists for you.
On the day of your test, you will pay the normal rate to your Instructor, for the use of the vehicle at your normal Instructors rate of 1 hour, and you will be taken home afterwards as you are not insured directly after test.
If you are not up to date with lesson payments, these must be paid prior to the vehicle being used for test.
10.3. Vehicle on Test
If the vehicle develops a fault that was not present prior to test or occurs on test, the examiner may refuse to/or abandon test. In such circumstances if all steps were taken in Clause 2.0.0 above; we cannot be held liable should you loose a test fee.
10.4. DVSA Examiner Strike Action / DVSA Test Cancellation
If the examiners call strike action, you will be instructed to turn up for test as normal, since not all examiners will be with the same union, and your test may still go ahead. Should your test not go ahead, the following procedure will take place:
1/. Your Instructor will still charge you for your pre-test, and test hour, which
you can treat as a mock test. You will be charged as normal for this, and your
Instructor will send you a receipt.
2/. You will be given a link to claim back the both the pre-test lesson, and test
hour that you paid for, from the DVSA.
3/. You don’t need to contact DVSA for a new test date, you will receive one in
the post automatically, within 14 days.
10.5 Vehicle Use for Test
We are NOT a vehicle hire company, and we do not allow anyone to take a test in our vehicles, that has not been taught by us. We appreciate that in some cases a parent may have taught you, and you are looking for a ‘few lessons’. Our Instructors are graded on the performance of each test candidate that we present. Therefore, we MUST carry out an assessment, and make a
recommendation to you based upon maybe only 1 training session. Should the recommendation be 7 lessons before test day, which is agreed, but you miss one or two lessons, the agreement is null in void. Furthermore, as we get closer to test time, we may suggest that you change your test date, based upon a performance in a particular area. You will be able to see this clearly on your Catz-i.com ADiT Total Drive App. Due to the short term that we have had with you, we will NOT ALLOW YOU TO USE OUR VEHICLE in these circumstances for test.
10.5.4. Agreed lesson agreement
At the time you agree with your Instructor to apply for your driving test, this will (unless otherwise stated), be on the basis that lessons continue on a routine basis. Since your Instructor is also graded on your performance, if you do not keep up with your agreement, of regular lessons, we may refuse you the use our vehicle for test. In the unlikely event of a test fail, you will agree with your Instructor what you need to work on, and the number of lessons required to rectify this. At the very minimum, 3 hours training, plus a 1 hour pre-test lesson will be required before the vehicle can be used for test.
10.5.5. Coming from another Driving School
Should you contact us with a test already booked, we first need to carry out a driving assessment. From this, using our Catz-i.com ADiT Total Drive App, you will see clearly, where you need to Progress & Develop. We will mark both the positive aspects of your driving, and any shortcomings. Your Instructor will then agree a the number of lessons with you, that they believe will be required to sort any issues out, and at the very minimum, 3 hours training plus a 90 minute pre-test lesson, will be required before the vehicle can be used for test.
11.0. Copyright
The PDR, Photographs & Filming materials are Copyright to Catz-i.com ADiT, and no part may be copied or reproduced in anyway without our express permission.
11.1. Social Media
Any photograph or video of you added to our social media can be copied and shared. You MUST give credit to the producers, Catz-i.com ADiT. If you do not wish to be shown online, please let us know BEFORE test day and we will not publish this or use on our website, as per our GDPR policy.
11.2. Social Media ’Help’
At this time Catz-i.com ADiT is not directly associated with any such groups outside of our business. Therefore we will not discuss with you directly, or indirectly about any other person or group. Further, you should also bear in mind that any dispute, MUST follow the procedure in clause 9.0. In the same way, we expect the same from you, and as part of our data protection agreement, you are also bound not to discuss our business dealings with another driving instructor, or driving school. In the event of a breach of trust and/or data, your Instructor and/or Catz-i.com ADiT,
reserve the right to take legal action against a breach that we deem has broken our agreement. Catz-i.com ADiT will pursue a claim to a maximum of £2,500,000.00 which will not include legal fees, recovery fees, and interest (at 8% above the Bank of England base rate), until paid in full and this fee will be doubled in the event where it is proven the comments and/or allegations were untrue and/or malicious.
11.3. Social Media Disputes
Neither Catz-i.com ADiT or the the learner/student or anyone directly or indirectly linked with you may raise an issue or dispute on social media, or post derogatory remarks. This includes ALL online platforms, including open or closed groups (open or encrypted), and review sites. Any dispute MUST follow the the procedure of Clause 9.0. Without prior consent out-with the terms of this document and clause 11.2 may be pursued.
12.0. The Company
Catz-i.com ADiT© is a Catz-eye.com™ company and are copyrighted and registered trade marked respectively.
13.0. Data Protection
Catz-i.com ADiT store all your information on our ‘Client Resource Management’ (CRM), whilst you are taking training with us, then up to two years from the last contact date. We NEVER share your information with anyone else and every possible effort is made to ensure the security of our system, which is passwords protected, on a 256bit encrypted cloud server, and/or our Catz-i.com ADiT Total Drive App. You can access our GDPR Policy here.
13.1 Filming
You will NEVER be filmed in our vehicles with cameras fitted, without your prior consent and knowledge. All cameras are positioned above shoulder height, and are visible in the vehicle. These will be pointed out to you on your lesson. If you agree to filming, you can access our filming agreement here.
14.0. Criminal Record Checks
All of our staff are DBS checked and cleared before they represent Catz-i.com ADiT. We check for any convictions, pending or spent regarding any violent, sexual, dishonest or obscene act.
15.0. Safety
It goes without saying that both your Driving Instructor and Driving Examiner, has the right to work without being subject to any violence, wether this be verbally, physically or of a threatening manner. In all cases, we will contact the Police and reserve the right not to give you any further Driver Training, nor present you for test. This includes verbal or physical behaviour against another road user, otherwise known as Road Rage.
16.0. Competitions
Competition entries are based on your Instructors participation in a promotion. The details of which Instructors participate will always be up to date on their web page and Facebook.
Closing dates and eligibility will be published separately for each competition and are not open to friends and family of any Instructor or employee of Catz-i.com ADiT. Judges decision is final and there will be no cash alternative offered, unless otherwise stated. Competition start and closing dates will be published on Facebook. Any participant with monies owing to their Instructor or Catz-i.com ADiT will be disqualified. Winners will be announced on Facebook, where by taking part you consent to your photograph being taken for publicity use.
17.0. Accepting these Terms of Business
As well as or instead of signing this document, you will be prompted to accept these terms by a tick, in your Catz-i.com ADiT Total Drive App. By continuing to take lessons supplied by Catz-i.com ADiT, it is deemed as acceptance of these terms of business, and forms a contract between you and your trainer. These terms may be updated from time to time with 14 days notice.
